Please read these Terms of Service ("Terms") carefully before using AgentMasher ("the Service") operated by AgentMasher ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

By accessing or using AgentMasher, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
AgentMasher is a SaaS platform that helps freelancers and agencies identify local businesses without websites, generate website previews for those businesses, and conduct automated outreach via email and AI voice calls. The Service integrates with third-party providers including Google Places API, AWS SES, and Vapi.ai.
3. Account Registration and Security
To use AgentMasher, you must be invited by an administrator and create an account. You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
- Ensuring your account information is accurate and up to date
4. Acceptable Use
You agree to use AgentMasher only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to send unsolicited bulk emails (spam) or harass recipients
- Scrape or misuse third-party data in violation of those services' terms
- Impersonate any person or entity
- Attempt to gain unauthorised access to any part of the Service
- Use the AI voice calling feature in jurisdictions where automated calls are prohibited without prior consent
- Use the Service for any illegal purpose or in violation of any applicable law
You are solely responsible for ensuring your outreach activities comply with all applicable laws, including CAN-SPAM, GDPR, CASL, and local telemarketing regulations.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
6. Third-Party Services
AgentMasher integrates with third-party services (Google, AWS, Vapi.ai, Twilio). Your use of these integrations is subject to the respective third parties' terms of service. We are not responsible for the availability or accuracy of third-party services.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of AgentMasher. Generated website previews are derivative works incorporating third-party business data (from Google Places) and are provided "as-is" for demonstration purposes only.
8. Limitation of Liability
To the maximum extent permitted by applicable law, AgentMasher shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of the Service, even if we have been advised of the possibility of such damages.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide reasonable notice of significant changes. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions.
